These terms apply when you use toadplants.com or purchase from ToadPlants. By placing an order, you agree to these terms.
1. About us
ToadPlants is a UK plant retailer. You can contact us at 1994benc@gmail.com. Our business address is 21 Corporal Close, Colchester CO2 7GT, United Kingdom.
2. Products
We take reasonable care to describe and photograph plants accurately. Plants are living products, so colour, leaf shape, size, growth and minor cosmetic marks can naturally vary. Availability is subject to stock.
3. Prices and payment
Prices are displayed in pounds sterling (GBP). Delivery charges are shown separately before you place your order. Any taxes that we are legally required to charge will be shown as applicable. Payment must be authorised before an order is accepted.
4. Orders
Submitting an order is an offer to buy. We will send an order acknowledgement, but the order is accepted only when we confirm acceptance or dispatch it. If a product is unavailable, a price is clearly incorrect or we cannot fulfil the order, we may cancel it and refund any payment received.
5. Delivery
We currently deliver within the United Kingdom only. Orders require one full working day to prepare and are normally dispatched on Wednesdays. Delivery estimates begin on dispatch. Full services, charges and delay information are set out in our Shipping Policy. Risk in the goods remains with us until they are delivered to you or a person you nominate.
6. Cancellations, returns and refunds
Live plants are perishable goods, so the usual change-of-mind cancellation right may not apply. Our Return and Refund Policy explains cancellations, transit damage and remedies. Nothing in these terms limits your statutory rights, including your rights where goods are faulty, damaged or not as described.
7. Website use
You may use this website only for lawful purposes. You must not interfere with the website, attempt unauthorised access, introduce malicious code, misuse customer information or use the website fraudulently.
8. Intellectual property
Unless otherwise stated, the text, branding, photographs and other content on this website belong to ToadPlants or our licensors. They may not be copied or commercially reused without permission, except where permitted by law.
9. Third-party services
Our store is hosted by Shopify and may use other third-party payment, delivery and technology providers. Their services may be subject to their own terms and privacy notices. Your purchase contract is with ToadPlants.
10. Liability
Nothing in these terms excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud, or your statutory consumer rights. We are not responsible for losses that were not reasonably foreseeable when the contract was formed. If you are buying as a consumer, we are not responsible for business losses.
11. Privacy
Our Privacy Policy explains how personal information is collected and used. Shopify also processes information to provide the store and checkout.
12. Changes to these terms
We may update these terms from time to time. The terms applying to an order are those available when the order is placed, unless a change is required by law.
13. Governing law
These terms are governed by the laws of England and Wales. If you live elsewhere in the United Kingdom, you retain any mandatory rights and may bring proceedings in the courts available to you under applicable consumer law.
